DUI 1st

The penalties for a DUI 1st can be harsh.  At a minimum the penalty for a DUI 1st offense conviction (not arrest) results in a 6 month license suspension, fines, enrollment in the Alcohol and Drug Safety Action program (ADSAP) which will cost between $500 – $2,000, SR-22 car insurance for 3 years, the possibility of jail for up to 30 days, and a permanent criminal conviction that does not qualify for expungement.

DUI 2nd

A DUI 2nd charges are heard in General Sessions court.  A conviction for DUI 2nd will result in a jail sentence of 5 days to 1 year and a fine between $2100 to $5100 if you refused the breath test or the result was 0.09 or less; a sentence of 30 days to 2 years and a fine of $2500 to $5500 if the breath test result was 0.10 to 0.15; or a sentence of 90 days to 3 years and a fine of $3500 to $6500 if your reported blood alcohol concentration was 0.16 or higher.

 

Your drivers license will be suspended for 1 year. Before being re-issued a drivers license you will have to enroll in the Alcohol and Drug Safety Action Program (ADSAP), and carry SR-22 insurance for  3 years.

DUI 3rd

A DUI 3rd charges are heard  in General Sessions court.  A DUI 3rd conviction results in a jail sentence of 60 days – 3 years and a fine between $3800 – $6300 if you refused the breath test or the result was 0.09 or less; a sentence of 90 days to 4 years and a fine between $5000 – $7500 if the breath test result was 0.10 to 0.15; or a sentence of 6 months to 5 years and a fine between $7500 – $10,000 if your BAC was 0.16 or higher.

 

Your drivers license will be suspended for 2 years. Before being re-issued a drivers license you will have to enroll in the Alcohol and Drug Safety Action Program (ADSAP), and carry SR-22 insurance 3 years.

DUI 4th

A DUI 4th is a felony with mandatory minimum prison sentences attached.
