Expungements in South Carolina

What is an Expungement?
In South Carolina, when you have a criminal arrest or conviction, that information is out there in the public view and this is where an expungement can help. An expungement is a Court Order either from a Magistrate or Municipal Judge or a Circuit Court Judge ordering the destruction of that criminal record from the public view.
How Will it Help?
It does more than just destroy your criminal record. It also orders the destruction of your fingerprints that were taken through the booking process. And sometimes most importantly, that mugshot that was also taken associated with that charge. What’s important to remember with expungements is that they’re not automatic. You have to make that request, and that means that you have to request that the correct court or the solicitor’s office, and that you have to file the correct paperwork and forms. And sometimes court fees associated with that expungement process.
